1. Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to use the Website:

• In violation of any applicable law or regulation.
• For the purpose of exploiting or harming minors or exposing them to inappropriate content.
• To transmit any content that violates intellectual property rights or infringes on the rights of others.
• To send unsolicited promotional material or spam.
• To impersonate the Company, other users, or any other entity.

2. Practitioner Responsibility

As a practitioner on Energetic Atlas, you are responsible for the content you upload and share, including playlists, event listings, and other materials. By uploading or sharing a playlist or any content, you confirm that:

• You hold all necessary rights or have obtained the necessary licenses to use and share any content, including music, images, videos, and text.
• If you use music or other content that is copyrighted, you are solely responsible for obtaining the necessary licenses or permissions to use this content.
• Energetic Atlas is not responsible for any claims, damages, or liabilities arising from the use of copyrighted material without the proper authorization.
• You are prohibited from sharing or distributing content that infringes on the intellectual property rights of others, including using music or other media without appropriate licensing or permission.

3. Rights of the Company Over Content

All content uploaded to Energetic Atlas is the property of the practitioner who created it. However, by uploading content to the website, you grant Energetic Atlas a non-exclusive, worldwide, royalty-free, and transferable license to use, display, distribute, and promote that content within the platform for the purposes of the services offered by Energetic Atlas. You retain the copyright over the content you upload, but you agree to indemnify and hold Energetic Atlas harmless from any claims arising from your content, including copyright violations.

4. Prohibited Uses

You agree not to:

• Use the Website in any way that could damage, disable, overburden, or impair the site.
• Use any automated system or software to extract data or scrape the Website.
• Introduce malicious code (e.g., viruses, worms, or Trojan horses) into the Website.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website.

5. Termination

We reserve the right to suspend or terminate your account and access to the Website at our discretion if you violate these Terms.

6. Limitation of Liability

To the fullest extent permitted by law, Energetic Atlas and its affiliates, officers, directors, employees, agents, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Website.

7. Indemnification

You agree to indemnify and hold harmless Energetic Atlas from any claims, damages, or expenses arising from your breach of these Terms or your use of the Website, including any violation of intellectual property rights.

8. Changes to Terms

We may modify these Terms at any time. Any changes will be posted on this page, and the revised Terms will be effective immediately upon posting.

9. Governing Law

These Terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Valencia, Spain.

Energetic Atlas™

11. Platform Summary

The Platform includes a marketplace where Pathfinders and Practitioners can find each other and connect online, and then meet for the provision of Treatments. Energetic Atlas does not charge any commission for the connection between Pathfinders and Practitioners. We provide the Platform to users (including hosting and maintaining the Platform), including but not limited to providing a platform for Pathfinders and Practitioners to form contracts between each other for the supply of Treatments.

Energetic Atlas™ is not a party to those contracts formed between a Pathfinder and a Practitioner for the supply of any treatments provided by a Practitioner.

12. Accounts

You may register on the Platform and create an account (Account) to access all of the Platform’s features. Certain features such as Listings may be available to people who have not yet created an Account.

You may have one (1) Account as a Practitioner and/or as a Pathfinder on the Platform.

You must provide basic information when registering for an Account, including your business name and country (for Practitioners), contact name, and email address, and you must choose a password.

Once you have registered an Account, you will be asked to create and curate a profile. 

You agree to provide accurate, current, and complete information during the registration process and regularly update such information to keep it accurate, current, and complete.

13. Payment

Energetic Atlas does not charge any commission for the contact between Pathfinders and Practitioners. All payments for Treatments are handled directly between the Pathfinder and the Practitioner.

15. Jurisdiction

These Terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Valencia, Spain.
